When you purchase a product from The Dizzy Knitter website you are acknowledging that you have read, understood and are accepting the following The Dizzy Knitter terms and conditions.

PRICE

All pricing is in United States Dollars. Pricing may be changed at our discretion and without notice. All credit cards are charged in US Dollars.

Typographical Errors: In the event a product is listed at an incorrect price or with incorrect information due to typographical error or due to incorrect information received from our suppliers, The Dizzy Knitter has the right to cancel the order.

RETURNS AND EXCHANGES

We would like you to read our Returns and Exchanges Terms carefully to ensure that you are fully aware of your rights when purchasing products (the Products) via our website. Your order signifies your agreement to be bound by these Purchase & Shipping Terms, which constitute the agreement between The Dizzy Knitter and you the customer.

If you are not satisfied with a product that you ordered online once you've had the chance to see it first-hand, you are welcome to return it to us within 30 days, unused and in a pristine saleable condition with the original packaging *(with the below exceptions) and we will refund your cost of goods - please note cost of shipping is at the expense of the customer - please ensure you contact us first before returning any goods.

Please contact us with your name, order number, product name, and reason for return. The Dizzy Knitter will then give you written authorization to return your package with return postage details, do not return the item without this authorization from us.

Damaged/faulty items: The Dizzy Knitter packages your items with care, so the occurrence of transit damage or faulty items is very rare, but should it occur please contact us at The Dizzy Knitter within 7 working days. Outside of this time no refunds or exchanges will be given.

  1. You must enter the correct delivery address and delivery instructions at the time of placing your order. If you enter an incorrect address, The Dizzy Knitter is not obliged to re-send the order to the correct address at our own expense, costs will be recharged to the customer.
  2. The damaged item/items must be returned within 10 days of contact with customer service.
  3. No returns or exchanges will be given after 30 days.
  4. Postage costs are at the expense of the customer unless the item is deemed faulty.
  5. The product (s) must be new, i.e. unused, unwashed, undamaged, unsoiled, and in their original packaging and/or tags attached.
  6. All freight costs for returns and deliveries of exchanges (excluding faulty goods) will be at the customer's expense. The Dizzy Knitter can not be held responsible for any products lost/damaged in transit.
  7. Refunds or exchanges will not be given on digital products.
  8. After assessing the condition of the returned products and if your refund is approved, we will send you an email confirming that your refund has been issued. Refunds will generally be processed within seven (7) business days of our receipt of returned products.
  9. All refunds will be issued via the same payment method used to purchase the products. There may be delays in the provision of the refund that may be caused by the issuing bank. Please contact us if you have not received your refund within ten (10) days of us notifying you that a refund has been issued.
  10. We do not accept returns of used items or:
  • Any item on sale
  • Any item marked as a special order item
  • Any item not in pristine resalable condition

 Safe Delivery & Authority to Leave

Most orders are sent by the USPS, ensuring that your order can be traced. Occasionally we also use selected couriers.

If no-one is at home when the courier delivers, you should receive a 'calling card' explaining where to collect the parcel from the Post Office (or for couriers, how to arrange redelivery).

If no-one will be at home during the day, you might consider having the order shipped to a work address.

All orders require your signature on delivery unless you tick 'Authority to Leave' and leave special delivery instructions in the Comments Box during Checkout for the order to be left in a safe location should you not be at home. Please note, however, that by doing so you take responsibility should the order go missing after it is delivered.

Dispute Resolution

General

In the interest of resolving disputes between you andThe Dizzy Knitter in the most expedient and cost-effective manner, you andThe Dizzy Knitter agree that any dispute arising out of or in any way related to these messaging terms and conditions ("Messaging Terms") or your receipt of text messages fromThe Dizzy Knitter or its service providers will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, which may allow for more limited discovery than in court and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate disputes includes all claims arising out of or in any way related to these Messaging Terms, or your receipt of text messages fromThe Dizzy Knitter or its service providers whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory and regardless of when a claim arises. YOU UNDERSTAND AND AGREE THAT, BY AGREEING TO THESE MESSAGING TERMS, YOU ANDThe Dizzy Knitter ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION AND THAT THESE MESSAGING TERMS SHALL BE SUBJECT TO AND GOVERNED BY THE FEDERAL ARBITRATION ACT.

Exceptions

Notwithstanding subsection 'General' above, nothing in these Messaging Terms will be deemed to waive, preclude, or otherwise limit the right of you orThe Dizzy Knitter to: (i) bring an individual action in small claims court; (ii) pursue an enforcement action through the applicable federal, state, or local agency if that action is available; (iii) seek injunctive relief in aid of arbitration from a court of competent jurisdiction; or (iv) file suit in a court of law to address an intellectual property infringement claim.

Arbitrator

Any arbitration between you andThe Dizzy Knitter will be governed by the Federal Arbitration Act and the Commercial Dispute Resolution Procedures and Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the American Arbitration Association ("AAA"), as modified by these Messaging Terms, and will be administered by the AAA. The AAA Rules and filing forms are available online atwww.adr.org, by calling the AAA at 1-800-778-7879, or by contactingThe Dizzy Knitter. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement.

Notice; Process

If you orThe Dizzy Knitter intends to seek arbitration, then the party seeking arbitration must first send a written notice of the dispute to the other party by U.S. Mail ("Notice").The Dizzy Knitter address for Notice is:35 W Main Street  Suite B #340  Ventura, CA 93001 Attn: Chief Executive Officer. The Notice must: (i) describe the nature and basis of the claim or dispute; and (ii) set forth the specific relief sought ("Demand"). During the arbitration, the amount of any settlement offer made by you orThe Dizzy Knitter must not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any.

Fees

If you commence arbitration in accordance with these Messaging Terms,The Dizzy Knitter will reimburse you for your payment of the filing fee, unless your claim is for more than $15,000 or as set forth below, in which case the payment of any fees will be decided by the AAA Rules. If the claim is for $15,000 or less, you may choose whether the arbitration will be conducted: (i) solely on the basis of documents submitted to the arbitrator; (ii) through a non-appearance based telephone hearing; or (iii) by an in-person hearing as established by the AAA Rules. If the arbitrator finds that either the substance of your claim or the relief sought in the Demand is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all fees will be governed by the AAA Rules. In that case, you agree to reimburseThe Dizzy Knitter for all monies previously disbursed by it that are otherwise your obligation to pay under the AAA Rules. Regardless of the manner in which the arbitration is conducted, the arbitrator must issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the decision and award, if any, are based. You andThe Dizzy Knitter agree that such written decision, and information exchanged during arbitration, will be kept confidential except to the extent necessary to enforce or permit limited judicial review of the award. The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees or expenses at any time during the proceeding and upon request from you orThe Dizzy Knitter made within 14 days of the arbitrator's ruling on the merits.

No Class Actions

YOU ANDThe Dizzy Knitter AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you andThe Dizzy Knitter agree otherwise in a signed writing, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

Modifications to this Arbitration Provision

Notwithstanding anything to the contrary in these Messaging Terms, ifThe Dizzy Knitter makes any future change to this arbitration provision, other than a change toThe Dizzy Knitter address for Notice, you may reject the change by sending us written notice within 30 days of the change toThe Dizzy Knitter address for Notice, in which case this arbitration provision, as in effect immediately prior to the changes you rejected, will continue to govern any disputes between you andThe Dizzy Knitter.

Enforceability

If an arbitrator decides that applicable law precludes enforcement of any of the limitations of subsection 'Modifications to this Arbitration Provision' above (addressing class, representative and consolidated proceedings) as to a particular claim for relief, then that claim (and only that claim) must be severed from the arbitration and brought in court. If any other provision of these Messaging Terms is found to be unenforceable, the applicable provision shall be deemed stricken and the remainder of these Messaging Terms shall remain in full force and effect.
